Collision Arbitrators

The following list of experienced practitioners who accept instructions to act as arbitrators in collision matters, particularly in connection with arbitration on documents alone pursuant to the ASG Standard Wording (ASG 7).

Archie Bishop

Collision & Salvage Arbitrator

Consultant - Holman Fenwick Willan

Archie specialises in admiralty law, focusing on collision, salvage, total loss and other casualties. He has vast experience in the investigation of large casualties, public enquiries, claims by local government and other authorities on oil pollution.

Archie trained aboard HMS Worcester and served as a Deck Officer with P&O. He has been the legal adviser to the International Salvage Union since 1981, and worked with the IMO legal committee in the preparation of the Salvage Convention of 1989. In addition, he was a member of the drafting committees for LOF 90, LOF 95 and LOF 2000 and SCOPIC. Archie is admitted as a solicitor in the UK and Hong Kong.

Tim Boden

Consultant - Holman Fenwick Willan

Tim specialises in salvage, collision, fire and explosion, total loss, limitation of liability, wreck removal, and both civil and criminal pollution liabilities. He also handles marine insurance coverage and other shipping related commercial and contractual disputes. He was involved in the Braer, Tiburon, Sea Empress, Herald of Free Enterprise, Sealand Express, Christoforo Colombo and others.

Tim is a member of the Honourable Company of Master Mariners.

Hugh Brown

Partner - Holman Fenwick Willan

Hugh specialises in shipping, including collisions, salvage, fire and explosion, total loss and both civil and criminal pollution liabilities. He represents Owners, Hull Underwriters, and P&I Clubs. He also handles marine insurance coverage and other shipping-related commercial and contractual disputes. He is the liaison partner for the Indian Sub-Continent and has represented Indian owners in a number of large casualty cases.

Hugh has acted as an arbitrator in both collision and salvage matters.

Ben Browne

Partner - Thomas Cooper

Ben is a partner in the London office and member of the casualty response team. He specialises in shipping with particular emphasis on casualty work and is a recognised leader in his field, having been involved in numerous high-profile salvage cases. Ben also specialises in insurance work and is an advisor to International Union of Marine Insurers and the London marine property underwriters on salvage and related issues. Ben has served on the Lloyd’s Salvage Group and its predecessors for over 10 years and was responsible for drafting most of SCOPIC.

Ben became a partner of Thomas Cooper in 2007. He was a partner at Shaw & Croft (2001-2007) and Clyde & Co. (1985-2001). Ben was admitted as an English solicitor in 1978 and read law at Trinity College, Cambridge.

Jim Cushman

Educated at Presentation College, Southampton University and Warsash nautical college.  A solicitor, partner and master mariner with 14 years seagoing experience including 5 years in command.  Specialises in collisions, salvage, total loss, wreck removal, pollution, general average and cargo claims.

Jim is admitted as a solicitor in England and Hong Kong

James Gosling

Partner - Holman Fenwick Willan

James specialises in salvage, collision, total loss, wreck removal and pollution, acting mainly for salvors, shipowners, hull underwriters and P&I Clubs. He also handles marine insurance, general shipping and commercial law MOA disputes, charterparty disputes and cargo claims. In addition, James is recognised as one of the industry's leading legal expert in piracy matters, having handled more than 70 piracy cases.  James is an accredited mediator.

Richard Gunn

Partner - Reed Smith

Head of Reed Smith's Casualty and Admiralty practice. His work includes investigating and advising on collisions, groundings, explosion, fire and salvage and their subsequent contractual and tortious disputes for a variety of clients including owners, clubs, underwriters and salvors. He has undertaken reviews of various contracts relating to provision of Port Services, STS, Towcon/hire, wreck removal and Emergency Towage Services.

Prior to legal practice, Richard qualified as a Master Mariner, spending 12 years on a variety of vessel types trading worldwide. He then spent five years operating a fleet of time chartered bulk carriers. He is a qualified mediator.

Richard Harvey

Richard Harvey qualified as a solicitor in 1980 and was for 25 years a partner and Head of Admiralty at Richards Butler (later Reed Smith). He is now a Consultant. He specialises in salvage, collision, wreck removal, oil pollution, fires and marine insurance. He has been closely involved in many inquiries and major cases such as the Erika, Prestige, European Gateway, Sealand Mariner, and the Tricolor/Kariba and Hyundai 105/Kaminesan collisions and sinkings. He also investigated the Hatfield and Great Heck railway accidents. He has sat on the Lloyd's Salvage Group and was a member of the Drafting Committee for Lloyd's Form 2011.

Richard was educated at Christ Church, Oxford and Southampton College of Technology and was four years in the British Merchant Navy before his legal career.

Darryl Kennard

Partner - Thomas Cooper

Darryl joined the firm in 1992 and became a partner in 2000. He spent five years in the Singapore office, returning to London in 2003. He is a member of the firm’s casualty response team and specialises in all aspects of ‘wet work’ from collisions and salvage through to total losses, fires and groundings. He also advises on claims made under bills of lading and charterparties.

Richard Morris

Richard is a partner in the London office and a member of the casualty response team. He specialises in shipping with particular emphasis on admiralty law. Richard has considerable experience in ship collisions and salvage as well as oil pollution claims, total losses, fires and groundings. Richard also deals with and has a wide experience of criminal offences at sea matters, regulatory investigations and fishing claims as well as insurance related disputes.

Richard became a partner in 2004 having joined the firm in 1985. Prior to that, he worked at the Treasury Solicitor’s Office.

Joe Quain

Admitted as a solicitor in 1995.  Served at sea in all ranks from Cadet to Master.  Handles all aspects of casualty work including collisions and salvage.

James Wilson

Joined in 1983, became a partner in 1991 and the firm’s global senior partner in 2008.  He specialises in all aspects of casualty work including collision, salvage, pollution and general average.  Qualified as a solicitor in both England and Hong Kong, James is also a qualified and practising commercial mediator.
